
Samsung will have to wait for few months for its case hearing against Apple regarding banning of iPhone 4S in Australia till next year 2012 in March.
Justice Annabelle Bennett told the Federal court in Sydney :-
The case will be fixed for a hearing for three weeks, commencing in March, 2012, with the date to be fixed on Friday.
I stand over the application for an interlocutory injunction, that will stand over to the same date, as that of the date of the hearing.
Where it seems that this case hearing date is too further away, Apple had initially planned to push this case further to August of 2012. Justice Bennett thought that would date would be inappropriate as it would make things tough for Samsung.
Samsung filed injunctions against Apple’s iPhone 4S sales in Australia, France, Japan and Italy last month of October, and all of them are still pending. Samsung accused Apple of 3G wireless patent infringements on its iPhone 4S.
Looks like Samsung would not be successful in making a huge negative impact on iPhone 4S sales even if it wins the court hearing because most of the people by then would have got the new smartphone anyway. Not only this, the next iPhone model would probably also release next year making iPhone 4S less important.
Even though it won’t make a big impact like Apple did to Samsung, it’s worth a try to get retribution/justice. Lets see what happens next year in Australia.
